VELORA YACHTING SL — YACHT CHARTER TERMS & CONDITIONS

These Terms and Conditions govern all yacht charter services provided by VELORA YACHTING SL (NIF: B26749440), registered at Calle Padre Luis García Cerezo, Num 6, 29680 Estepona, Málaga, Spain. By booking a charter with Velora Yachting, the Charterer agrees to these terms in full.

1. CHARTER ROUTE & CONDITIONS

The exact charter route is confirmed on the day of the charter by the Captain at the point of boarding. The route may be adjusted at the Captain’s discretion based on weather and sea conditions.

A refund of the charter fee will only be issued in the event of:
— Adverse weather conditions confirmed by the Captain as unsafe for sailing
— Mechanical failure of the vessel

Early return to port at the request of the Charterer or any member of the charter party does not entitle the Charterer to a full or partial refund. If the Charterer is informed that sea conditions are uncomfortable (strong winds, large waves) and chooses to proceed, no refund will be issued upon early return.

2. CHARTERER’S RESPONSIBILITIES

2.1 Children
The Charterer accepts full responsibility for the behaviour and safety of any children brought on board. No crew member bears responsibility for children’s behaviour or entertainment.

2.2 Water Toys
The Charterer understands that water toys (jet ski, inflatable pool, SeaBob, crazy sofa, wakeboard, electric surfboard, paddle surf, donut, snorkel equipment) are included as part of the charter but are subject to safe weather and sea conditions. If conditions do not permit safe use of water toys, the charter fee remains unchanged. The Captain determines when water toys may be used and when they must be withdrawn. The inflatable pool is available on 8-hour charters only.

2.3 General Conduct
The Charterer accepts full responsibility for the conduct of all persons in their party. All guests must follow the instructions of the Captain and crew at all times. Shoes must be removed before boarding and stored in the designated area. Animals may only be brought on board with prior written consent from Velora Yachting.

2.4 Health
By booking a charter, the Charterer confirms that all members of the party are in a state of health suitable for participation in a yacht charter. Velora Yachting accepts no responsibility for any pre-existing medical conditions.

3. DAMAGE & LIABILITY

The Charterer is financially responsible for any damage caused by themselves or any member of their party. Payment for damages is due on the day of the incident, prior to disembarkation.

Damage valuations are as follows:
— Jet ski: €8,000
— SeaBob: €12,000
— Electric surfboard / inflatable pool / inflatable slide: €7,000
— Crazy sofa / wakeboard: €500
— Paddle surf / donut: €300
— All other damage: based on repair or replacement cost as assessed by Velora Yachting

Velora Yachting and its crew accept no responsibility for personal items left on board by the Charterer or their party.

4. VELORA YACHTING’S OBLIGATIONS

Velora Yachting undertakes to:
— Provide a qualified, licensed Captain and crew for the duration of the charter
— Comply with all applicable Maritime regulations
— Maintain valid third-party liability and accident insurance on the vessel
— Ensure the vessel is equipped with life jackets for adults and children
— Ensure the vessel carries a first aid kit and fire extinguishers
— Provide all included catering and beverages as described at the time of booking

5. ABSOLUTE PROHIBITIONS

The following are strictly prohibited on board and will result in immediate termination of the charter without refund:

— Use, possession or transport of illegal drugs or substances of any kind
— Possession or use of any weapon including firearms
— Smoking anywhere on the vessel
— Transport of undocumented persons or participation in any illegal activity

Any resulting fines, detentions or legal costs incurred by Velora Yachting as a result of prohibited conduct by the Charterer or their party will be charged in full to the Charterer.

6. CREW CONDUCT & CHARTER TERMINATION

No member of the Velora Yachting crew may be subjected to any form of harassment — verbal, physical or sexual — at any time during the charter. Violation of this condition will result in immediate termination of the charter without refund.

The Captain reserves the right to warn the Charterer of any breach of these Terms. If the breach continues after a warning, the charter will be terminated immediately, the vessel will return to port, and no refund will be issued.

7. GOVERNING LAW
─────────────────────────────
These Terms and Conditions are governed by Spanish law. Any disputes shall be resolved by the courts of Marbella, Málaga, Spain. Criminal matters shall be dealt with by the court of the jurisdiction in which the offence was committed.
